Terms of service
These terms are an agreement between you and Carterdea LLC (“we”, “us”), which operates Sale Sight. “You” means the business that installs Sale Sight on its Shopify store and the person installing it on that business’s behalf.
Accepting these terms
By installing or using Sale Sight, you agree to these terms and to our privacy policy. If you do not agree, do not install or use the app.
Sale Sight is for business use only. You must be at least 18, able to form a binding contract, and authorized to act for the store you install it on.
The service
Sale Sight displays eligible Shopify automatic discounts on the product and collection pages of your online store. It reads product and discount data through the Shopify API and runs through a theme app embed you turn on and off in the theme editor. It does not change your product prices, compare-at prices, or discounts in Shopify.
Sale Sight only shows certain discount types. Which discounts are supported is described on salesight.app, on the support page, and in the app. Discounts that Sale Sight does not support are not shown, and the price at checkout is always set by Shopify, not by Sale Sight.
Your responsibilities
- You are responsible for your store, your discounts, your prices, and what your storefront tells customers.
- You decide which discounts to run and how long they run. Sale Sight displays them; it does not create, approve, or verify your pricing claims.
- You are responsible for making sure your prices, sale claims, and promotions comply with the laws that apply to your store, including laws on former prices and reference pricing. Anything we say about pricing laws, on our site or in the app, is general information and not legal advice.
- Check how Sale Sight displays prices on your theme after setup and after theme changes, and contact us if something looks wrong.
- Keep your Shopify account and the app’s access in good standing.
Fees and billing
All charges for Sale Sight are billed through Shopify and appear on your Shopify bill. We do not charge you outside Shopify, and every charge must be approved by you in Shopify first.
- Plans. Plans are priced by your store’s monthly storefront pageviews. Current plans and prices are shown on salesight.app and in the Shopify App Store listing.
- Free trial. If a plan includes a free trial, you are not charged during the trial. If you uninstall before the trial ends, you are not charged.
- Plan changes. You can change plans from inside the app. Shopify handles any proration or credit under its billing rules.
- Price changes. If we change the price of your plan, we will tell you in advance and Shopify will ask you to approve the new price before it applies.
- Refunds. Refunds, if any, are issued through Shopify and follow Shopify’s billing rules. We may issue a refund or credit at our discretion.
- Taxes. Shopify may add applicable taxes to app charges.
Pageview limits
Each plan covers a monthly number of storefront pageviews. If your store goes over its plan’s limit, nothing changes right away and you are not charged extra. We will contact you and ask you to move to a plan that fits your traffic. Because Shopify requires your approval for any new charge, an upgrade only happens if you accept it.
If your store stays over its limit for a sustained period after we have contacted you, we may pause Sale Sight’s storefront display until you choose a plan that fits. While paused, your store keeps working and shows its regular prices.
Acceptable use
You agree not to:
- Use Sale Sight in violation of any law, Shopify’s terms, or the rights of others
- Use Sale Sight to display false or misleading prices or sale claims
- Interfere with, overload, or try to gain unauthorized access to Sale Sight or its systems
- Copy, reverse engineer, resell, or build a competing product from Sale Sight, except where the law allows it
- Use automated means to inflate pageviews or otherwise get around plan limits
Intellectual property and feedback
We own Sale Sight, including its software, design, and branding. While you have the app installed and follow these terms, we give you a limited, non-exclusive, non-transferable right to use it for your store.
You own your store data. You give us permission to access and use it only as needed to provide and improve Sale Sight, as described in the privacy policy.
If you send us ideas or feedback, we may use them without any obligation to you.
Shopify and other third parties
Sale Sight runs on Shopify and depends on Shopify’s platform, APIs, and billing. Your use of Shopify is governed by your own agreement with Shopify. Shopify is not a party to these terms and is not responsible for Sale Sight.
Sale Sight also works alongside your theme and other apps, which are made by third parties. We are not responsible for third-party products, and changes to them can affect how Sale Sight displays prices.
Availability and changes
We work to keep Sale Sight running and accurate, but we do not promise it will be uninterrupted or error free. If Sale Sight is unavailable, your store keeps working and shows its regular prices.
We may change, add, or remove features. If a change materially reduces what your paid plan includes, we will tell you in advance.
We may update these terms. We will post changes on this page with a new date and, for material changes, notify you by email or in the app before they take effect. If you keep using Sale Sight after changes take effect, you accept the updated terms.
Suspension and termination
You can stop using Sale Sight at any time by uninstalling it from your Shopify admin.
We may suspend or end your access if you breach these terms, if your use creates a security or legal risk, if Shopify requires it, or if we stop offering Sale Sight. Where reasonable, we will give you notice first. If we stop offering Sale Sight entirely, we will give you at least 30 days’ notice.
When you uninstall or your access ends:
- Sale Sight stops displaying discounts and your store shows its regular prices
- Shopify ends future app charges, and charges already incurred are not refunded except as described in Fees and billing
- We delete or retain your data as described in the privacy policy
Sections that by their nature should survive, including intellectual property, disclaimers, limitation of liability, indemnity, and governing law, survive termination.
Warranty disclaimer
Sale Sight is provided “as is” and “as available”, without warranties of any kind, to the fullest extent permitted by law. This includes implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Sale Sight will be error free, that it will work with every theme or app, or that any price display will meet the legal requirements that apply to your store.
Limitation of liability
To the fullest extent permitted by law, our total liability for all claims relating to Sale Sight or these terms is limited to the greater of the fees you paid for Sale Sight in the 12 months before the claim arose, or $100.
We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, sales, data, or goodwill, even if we were told they were possible. These limits apply to any legal theory and do not apply where the law does not allow them.
Indemnity
You will defend and indemnify Carterdea LLC against third-party claims, and related losses and reasonable legal fees, that arise from your store, your prices and promotions, your breach of these terms, or your violation of any law or third-party right.
Governing law and venue
These terms are governed by the laws of the State of Arizona, without regard to conflict of law rules. Any dispute relating to these terms or Sale Sight will be brought only in the state or federal courts located in that state, and both parties consent to their jurisdiction.
Notices
We may send notices to the email address associated with your Shopify store or in the app. You can send notices to us at support@salesight.app.
General
- Assignment. You may not transfer these terms without our written consent. We may transfer them in connection with a merger, acquisition, or sale of Sale Sight.
- Entire agreement. These terms and the privacy policy are the entire agreement between you and us about Sale Sight.
- Severability. If any part of these terms is found unenforceable, the rest stays in effect.
- No waiver. Not enforcing a part of these terms is not a waiver of our right to enforce it later.
